Terms of Service

These Terms govern access to BIVANEX business operations, inspection and automation services, including BIVANEX Inspect and Hermes. A separate signed agreement with a customer controls where it conflicts with these Terms.

1. Authorized business use

You may use the service only if you are authorized by the organization that controls the relevant BIVANEX tenant and can form a binding agreement. You must provide accurate information, protect credentials and promptly report unauthorized access.

2. Customer responsibility and professional judgment

The customer controls its tenant data, users, retention choices and connected accounts. Users are responsible for the legality, accuracy and authority of material they submit.

BIVANEX may organize evidence, retrieve authorized precedent and prepare drafts. Historical reports are precedent only and are never proof of current equipment condition. Final findings, classifications, approvals, signatures and regulated decisions must be made by appropriately authorized people. BIVANEX does not replace a qualified inspector, certifier, engineer, safety professional or legal adviser.

3. Connected services

Google, Meta/WhatsApp and other integrations are optional and require the account owner’s authorization. The user must comply with each provider’s terms. Access may stop if permission is revoked, a provider changes its service, or the connection becomes unsafe or unlawful.

4. Acceptable use

You must not use BIVANEX to violate law or third-party rights; access another tenant; upload malware; bypass security or review controls; send spam; misrepresent professional authority; create deceptive or unsafe reports; or reverse engineer, disrupt or overload the service.

5. Data and intellectual property

The customer retains rights in customer-submitted data. The customer grants BIVANEX the limited right to process that data to provide, secure and support the service. BIVANEX retains rights in the platform, software, documentation and service design. Feedback may be used to improve the service without exposing customer confidential information.

6. Availability and changes

We work to keep the service reliable and secure, but uninterrupted availability is not guaranteed. We may change or suspend a feature when needed for security, compliance, provider changes or maintenance, and will provide reasonable notice when practicable.

7. Suspension and termination

Access may be limited or suspended for material breach, security risk, unlawful use or non-payment under an applicable agreement. On termination, data handling and export follow the customer agreement and our Privacy Policy. Users may request deletion through the Data Deletion page.

8. Disclaimers and liability

To the extent permitted by law, the service is provided without warranties not expressly stated in a signed agreement. BIVANEX is not responsible for decisions made without required human review, inaccurate customer-supplied information, or failures of third-party services. Liability is limited to the extent allowed by applicable law and any controlling customer agreement.

9. Governing law and contact

Unless a signed customer agreement states otherwise, these Terms are governed by the laws of the State of Israel, without regard to conflict-of-law rules. Questions may be sent to benyamin@bivanex.com.
